I, Mari Martinez herby known as Seller, herein state that to the best of my knowledge and/or Veterinarian that this puppy/dog is to be physically healthy.

Buyer shall have 7 days to have puppy/dog given a wellness check by his/her choice of a licensed Veterinarian.

In case of dire illness within the 7-day health period or with 1 year "proven genetic defect" guarantee the seller will exchange puppy/dog for another one of equal value. Seller is to be notified of any such finding immediately within 24 hours so proper adjustments can be made. At no time, will there be a refund given back to buyer. A written explanation and or documented proof shall and MUST be shown at the time of exchange. This is to include te Veterinarians name, address and such date of his/her findings. A copy is to be provided by the seller at the time of exchange. Failure to do so will delay exchange or be voided.

Exchange shall be left up solely to the sellers discretion.

If puppy/dog is not Vet checked within the specified time this agreement is voided.

A Health Record has been given to the buyer at the time of sale stating all medications, vaccinations and worming has been given to puppy/dog as of this date

If at any point or time buyer decides they can no longer care for said puppy/dog, Breeder must be notified and be given 1st option to have said puppy/dog at no cost. Said puppy/dog MUST NOT be resold, be place in a shelter or humane society at any point or time!

Failure to follow this contract will entitle the Breeder to the amount of $500 as a result of Breach of Contract and any Legal Fees associated with any Legal Actions.

The Buyer understands this is a LEGALLY Binding Contract.

A Merle is a Gene that dilutes the black on Pomeranian's in irregular patches all over the body. The patches vary in size from small, medium and large. Sometimes you will get a Litter of puppies that are hard to determine if they are a Merle.

These are called Merle Factored which means they can produce Merle offspring's.

Merle & Merle Factored Puppies should NEVER be Bred o any of the following Colors;

- Red

- Orange

- Cream

- White

-Sable

By signing this contract you agree to follow said guidelines.

The only Color's that you should consider breeding to Merle's are the following Colors;

- Black

- Chocolate

- Blue

- Black & Tan

- Chocolate & Tan

- Black Parti-Color or Tri-Color

- Chocolate Parti or Tri Color

- Blue & Tan

You ONLY NEED ONE Merle to produce a Merle Dominant.

This also means ONE PARENT MUST BE A MERLE to produce Merle Puppies.

Pleas Note; YOU SHOULD NEVER BREED MERLE TO MERLE! This combination is EXTREMELY lethal because a Merle is NOT a Color but a Gene and is VERY dominant at that.

Merle to Merle Breeding can result in deafness, blindness, deformed and even dead puppies!

PLEASE!! Be a RESPONSIBLE owner/Breeder.

DEPOSIT CONTRACT AGREEMENT

This Contract is to specify the Purchase Agreement of My Secret Pom’s

I the breeder, Mari Martinez have spoken to the buyer about the Purchase Agreement upon purchasing one of My Secret Pom’s Puppy/Puppies which includes:

If Buyer is placing a Deposit on a specific Color and Gender Buyer MUST BE AWARE that said Color and/or Gender may not be Available on Upcoming Litter’s
Breeder has RIGHT to 1st Pick of any Litter’s (Unless said otherwise)

3. If at any point or time Buyer changes their mind and or walks away on so puppy there will NOT be a refund on Deposit made.

4. Buyer's Deposit NEVER Expires With My Secret Poms unless Buyer changes it’s mind or walks away on said puppy

5. Buyer has placed a Deposit for (Unless Said Otherwise)

6. Buyer’s Deposit can be transferred over to any of My Secret Poms Dam’s Litter’s (Unless Said Otherwise)

7. If Buyer is buying to Breed Buyer is aware Female’s MUST BE over 4LB Full Grown to be considered for Breeding

8. Buyer has the right to wait for the right puppy from any of My Secret Poms Dam's

9. Breeder has the Right to Refuse Sale at any point in time in which Deposit will be returned to Buyer

*PLEASE NOTE: Breeder will NOT know Color or Gender of Puppies in Litter until said Litter is born. Breeder does NOT guarantee your choice of Color and Gender will be born on upcoming Litter.
